Hello, This is MakeStar. In order to provide you with a more satisfactory PocaAlbum service, we have posted these individual terms and conditions to introduce you to the contents of the PocaAlbum service, rights and obligations, and other needs, and to facilitate communication between you and MakeStar. Thank you for using the PocaAlbum service.
Article 1 (Definitions)

The definitions of the terms used in these Terms and Conditions are as follows.

Thank you for using the PocaAlbum service.
Article 1 (Definitions)

The definitions of the terms used in these Terms and Conditions are as follows.
(1) The terms used in the PocaAlbum Terms of Service have the same meaning as the terms defined in MakeStar's Membership Agreement.
(2) The term 'Album Card' refers to a card-shaped album created to confirm the usage rights of digital contents such as sound recordings contained in PocaAlbum by scanning or tagging, and to allow users to use digital contents through the PocaAlbum app.
(3) 'Scan' refers to the act of recognizing the QR code of a QR album through the camera function of the Poka Album App.
(4) 'Tag' refers to the act of reading the NFC chip of an NFC album through the NFC recognition function of the Foca Album app.
(5) The term 'QR album' refers to a Poka Album that includes an 'album card' with a QR code on the back as a package.
(6) 'NFC album' refers to a package containing an 'album card' with an embedded NFC chip.
(7) 'In-app payment' refers to a payment method supported by an 'app platform provider'.
(8) 'Dream Star' is a paid good that can be used to purchase products.
(9) 'Mission' refers to a system that tracks users' in-app activities such as attendance and ad viewing and provides rewards.
(10) 'Joy Star' is a free good that can be used to purchase products, etc.
Article 2 (PocaAlbum Album Registration and Usage Guide)
1.
PocaAlbums can be registered in the 'Account' by 'Scan' or 'Tag' method after logging in to the PocaAlbum app as 'Account'.
2.
'Albums' registered to an 'Account' can only be used through that 'Account' and cannot be canceled or transferred to another 'Account'.
3.
By registering a Foca Album in an Account, a Member acquires the right to use the Digital Content contained in the registered Foca Album.
4.
'Members' can use the 'Digital Content' to which they have acquired the right of use by logging in to the Pokka Album App.
Article 3 (Downloading, Deleting, and Reusing Albums)
1.
focaalbum may store music and other digital contents (hereinafter referred to as 'album data') in the local storage of the 'member's smartphone device for smooth use of the service and reflection of domestic music charts.
2.
The local storage in use can be restored by deleting the 'Album Data' downloaded within the Pokka Album app or by deleting the data of the Pokka Album app in the smartphone settings.
3.
If you delete the 'Album Data' downloaded within the Pokka Album App, the 'Member' can download and reuse the 'Album Data' at any time.
Article 4 (Purchase, Refund and Delivery of Poca Album)
1.
The purchase, refund, and delivery of Poka Album are made on MakeStar's official website (https://makestar.co) and are subject to the Terms of Service of MakeStar's official website.
2.
Customer service related to the purchase, refund and delivery of the Poka Album is provided on the official website.
Article 5 (Contract for Use of 'Paid Service')
1.
The 'Paid Service' use contract is concluded when the 'Member' applies for the 'Paid Service' use contract by selecting the paid service to be used and requesting payment, and the 'Company' approves the 'Member's' application.
2.
Before applying for a paid service use contract, the 'Member' shall familiarize himself with the terms and conditions specified by the Company and the contents of the product information on the purchase page.
3.
The 'Company' shall, in principle, accept the paid service use contract of the 'Member' (displayed as transaction history in the app) except in the following cases.
(1) If a minor wishes to use a paid service that is prohibited by relevant laws and regulations.
(2) If there is a technical or business problem with the operator.
4.
The time of establishment of the use contract shall be the time when 'Subscription completed' or 'Purchase completed' is displayed in the service.
Article 6 (Use of 'Paid Services')
1.
'Paid Services' are provided for 'Members'.
2.
The paid services provided by the 'Company' are as follows, and the service contents may be added, changed, or deleted according to the conditions of the 'Company'.
(1) Purchase of 'Dreamstar'
3.
The 'Member' can pay the fee by the payment method specified by the 'Company' as follows, and the payment method can be added, changed, or deleted according to the conditions of the 'Company'.
(1) 'In-app payment'
Article 7 (Discontinuation and Change of 'Paid Service') 1.
1.
The 'Company' may discontinue the provision of the 'Paid Service' if it becomes impossible to provide the 'Paid Service' for reasons such as terminating the 'Paid Service' or changing the 'Service' type. In this case, the'Company' shall notify the member in the manner prescribed in Paragraph 3 and compensate the member according to the conditions originally proposed by the company or as prescribed by the'Content User Protection Guidelines' and related laws and regulations.
2.
The'Company' may change all or part of the'Paid Service' provided in accordance with operational and technical needs if there is a substantial reason such as deterioration of management or natural disaster, and notify the'Member' in the method prescribed in Paragraph 3 before the change. If the changed contents are unfavorable to the 'Member', the 'Member' may not agree to the changes and may terminate the paid service use contract.
3.
The 'Company' may notify the 'Member' of the suspension or change of the 'Paid Service' in the following ways.
(1) Push message in 'App Service'
(2) Email in the 'Account'
(3) Notice in the 'App Service'
Article 8 (Withdrawal, Termination, and Refund of Paid Services)
1.
A 'Member' who has concluded a contract for the use of the 'Paid Service' may withdraw his/her subscription within 7 days as stipulated by relevant laws and regulations. However, if it falls under the reasons for non-revocation of subscription stipulated in the <Content Industry Promotion Act>, <Act on Consumer Protection in Electronic Commerce, etc.>, the'Company' shall take necessary measures under the relevant laws and regulations.
2.
The cases where the subscription cannot be withdrawn are as follows.
(1) When using goods or products acquired through the'Paid Service'
(2) In the case of viewing the contents provided by the 'Paid Service'
(3) If you have contracted a 'paid service' with immediate effect
(4) If the 'Member' has received a transfer of the 'Paid Service' from a third party other than the 'Member' himself/herself.
3.
'Member' may terminate the 'Paid Service' usage contract in any of the following cases, and refunds will be made in accordance with the refund operation policy of the 'Company' and each application store.
(1) If the 'Company' stops providing the 'Paid Service'
(2) If the 'Member' disagrees with the contents of the 'Paid Service' changed by the 'Company'.
(3) If the'Company' does not improve the defects of the'Paid Service' within one month from the date of the'Paid Service' use contract.
4.
If the cause of subscription withdrawal or refund is due to reasons attributable to the Company, such as the Company's service abolition, the Company shall bear the cost of refunding the purchase price. However, in other cases, the Company shall deduct the profit earned by the user from the use of the paid service and the fee for the refund and refund it.
5.
If the 'Member' arbitrarily receives a subscription withdrawal despite the fact that it is not possible to withdraw the subscription, the 'Company' may limit, suspend or deprive the membership in accordance with Article 10, Paragraph 4 of the Membership Agreement.
Article 9 (Dreamstar)
1.
'Members' can acquire 'Dream Star' by making a paid payment.
2.
'Dream Star' belongs to the acquired account and cannot be transferred or sold to another account.
3.
Dream Stars can be used indefinitely.
4.
Once redeemed, Dream Stars cannot be canceled or redirected.
5.
You can check the acquisition and usage history of 'Dream Star' on your My Page.
Article 10 (Free Services)
1.
Free services are provided to 'Members'.
2.
'Members' who agree to the Terms of Membership, Terms of Service, and Privacy Policy when creating an 'Account' can use the free services provided by the 'Company' without entering into a separate use contract.
3.
The'Company' may update the software to provide better services, and the'Member' is requested to update it continuously to use the service.
4.
The'Company' may provide notices or management messages about the services being provided for smooth service use through push messages. However, in the case of messages containing the contents of promotion and marketing, they are sent only to 'members' who have agreed to receive them in advance.
5.
The'Company' may change or suspend the supply of free services without the consent of the'Member', and notify the'Member' in advance or afterward for important contents.
Article 11 (Joystar)
1.
'Company' may provide 'Joy Star' for free according to the conditions set by 'Company'.
2.
'Members' can acquire 'Joy Star' in the following ways, and if there is an error in the acquisition, they can apply for correction within a reasonable period of time, and the 'Company' will take action through the confirmation procedure of the 'Member's correction application.
(1) Rewards for participation in 'missions' in the service

'Joy Star' belongs to the acquired account.
4.
'Joy Star' has the following expiration date, and after the expiration date, it will be destroyed and cannot be used, and 'Member' cannot demand restoration or compensation for the destroyed 'Joy Star'.
(1) Expiration date: 90 days (KST) from the date of acquisition. (Automatically)
5.
'Joy Star' cannot be canceled or redirected once used.

You can check the acquisition, usage, and expiration details of 'Joy Star' on your My Page.
Article 12 (Special Rules for Minors' Use Contracts)
1.
The'Company' shall take measures to notify the minor or his/her legal representative that the contract may be canceled if the minor or his/her legal representative does not obtain the consent of his/her parent or other legal representative after concluding the contract when the'Member' who is a minor intends to use the paid service.
2.
Notwithstanding the preceding paragraph, if the minor or his/her legal representative concludes a contract for the use of a paid service by stealing another person's information or using another person's account, the minor may not cancel the contract even if the legal representative has not consented.
Article 13 (Change of 'Digital Content')
1.
The 'Company' may change the content services provided according to operational and technical needs if there is a substantial reason.
2.
If the'Company' changes the content, method of use, and time of use of the content service, the reason for the change, the content of the content service to be changed, and the date of provision shall be posted on the initialization screen of the content for at least 7 days before the change.
3.
If the changes made in the case of Paragraph 2 are significant or disadvantageous to the 'Member', the 'Company' shall notify the 'Member' receiving the content service in question in the manner specified in Article 10 "Notification of Paid Services" and obtain consent. At this time, the 'Company' shall provide pre-change services to the 'Member' who refuses to consent. However, if it is not possible to provide such services, the contract may be terminated.
4.
The 'Company' shall compensate the 'Member' for any damages caused by the change of the 'Digital Content'. However, the 'Company' shall not be liable if the 'Digital Content' is changed at the request of the original owner or copyright holder of the 'Digital Content'.
Article 14 (Overseas Use)
The 'Company' does not guarantee the quality of the PocaAlbum service in areas other than the territory of the Republic of Korea. Therefore, if the 'Member' intends to use the PocaAlbum service in areas other than the territory of the Republic of Korea, the 'Member' shall decide whether to use it according to his/her own judgment and responsibility, and in particular, the 'Member' is responsible for complying with local laws and regulations in the process of using the PocaAlbum service.
